PANAMA DIVORCE BY MUTUAL CONSENT PROCEEDINGS

In articles 212 and following, the Family Code establishes the proceedings and requirements for registering a divorce by mutual agreement. Moreover, on the 30th of December 2021, the enactment of Law No. 269 modified ordinals 9 and 10 of Art. 212, and the ground for facto separation and mutual consent divorces were modified as follows:

No. 9. The de facto separation of the spouses for more than one year, even if they live under the same roof.

No. 10.

  1. That the spouses should be of legal age.
  2. At least one year has elapsed after the marriage.
  3. The spouses must ratify their desire for divorce within six months of applying for divorce, provided that two months have already elapsed after applying for a divorce.

The new legislation also stipulates that the parties must provide evidence that everything concerning the children’s guardianship, visits, and alimony has been resolved and is binding for the spouses.

These changes allow judges to expedite their work, and spouses can proceed with their divorce without unnecessary delays.
