Panama Trademark Renewal
Entity in charge: Directorate General of the Registry of the Industrial Property of the Ministry of Commerce and Industries.
General Information:
- The renewal process is straightforward. A petition must be filed with the Trademark Office within a year before the registration expires.
- After the registration expires, there is a period of six (6) months to request the renewal of the mark by paying an additional late fee of US$10.00 per month. During this period, the registration will maintain its full validity.
- It is important to note that it is not mandatory to submit any evidence or declaration of use of a Trademark to obtain its renewal. Panamanian law does not provide a term to prove use after registration. However, the lack of use of a trademark for more than five consecutive years from the date of registration shall end in cancellation of the registration. Cancellation may be requested by any natural or legal person who is considered to have the right to do so in accordance with the procedure established for claims of opposition.
- The concept of use includes international and domestic use.
